Terms & Conditions
These Terms govern your relationship with the operator of the online gambling services made available via oshi-aussie.com as accessed through Oshi (the "Site"). By using the Site or opening an account, you agree to be bound by these Terms. If you do not agree, you must not use the Site. These Terms are effective from 1 January 2026.
Definitions
In these Terms, unless the context requires otherwise:
- "Operator" means Dama N.V., a public limited company incorporated under the laws of Curaçao with registration number 152125, holding Curaçao e-gaming licence no. 8048/JAZ2020-013 issued by Antillephone N.V., together with its payments processing subsidiary Strukin Ltd, a company incorporated in Cyprus, to the extent it processes payments on behalf of Dama N.V.
- "Site" means the website located at oshi-aussie.com and any related landing pages, including but not limited to Oshi pages, through which you access the Operator's services.
- "Services" means the online gambling and related services, including casino games, betting facilities, promotions, and customer support made available by the Operator via the Site.
- "User", "you", "your", "Player" means any natural person who accesses the Site and/or opens, holds, or uses a player account with the Operator.
- "Account" means a registered player account created by a User on the Site and maintained by the Operator for the purpose of using the Services.
- "Bet" or "Wager" means any sum of money or monetary value (including the value of bonus funds or free spins) staked by you on the outcome of any game, event, or other gambling activity offered via the Services.
- "Real Money Balance" means funds you have deposited to your Account (and any resulting cash winnings) which are not subject to wagering requirements.
- "Bonus" means any promotional benefit granted by the Operator, including bonus funds, free spins, cashback, tournament entries or similar, which may be subject to specific eligibility, wagering, or withdrawal conditions.
- "Bonus Funds" means non-withdrawable funds credited as part of a Bonus until all applicable conditions are met.
- "Wagering Requirements" means the total value of bets you must place using Bonus Funds and/or Real Money Balance before Bonus Funds or any associated winnings become withdrawable.
- "Prohibited Jurisdiction" means any jurisdiction where online gambling with the Operator is not lawful, restricted by applicable law, by the Operator's licensing conditions, or where the Operator has chosen not to offer Services, which may include, without limitation, Australia as further explained below.
- "KYC" (Know Your Customer) means identity verification checks undertaken by the Operator to confirm your identity, age, place of residence, source of funds, and other relevant information.
- "Interactive Gambling Act" means the Interactive Gambling Act 2001 (Cth) and related regulations applicable in Australia.
- "Business Day" means any day other than a Saturday, Sunday, or public holiday at the Operator's principal place of business.
Account Registration
Eligibility and age requirements
- Minimum age: You may only register and use an Account if you are at least 18 years of age, or older where the applicable law in your place of residence sets a higher minimum age for online gambling. The Operator will take reasonable steps, including KYC checks, to verify your age. Any use of the Services by a minor is strictly prohibited and will result in immediate account closure and forfeiture of any winnings.
- Legal capacity: By registering, you confirm that you have full legal capacity to enter into binding contracts and that you are acting on your own behalf and not for any third party.
- Prohibited Jurisdictions and Australian players: The Services are offered under a Curaçao licence. The Operator does not hold an Australian gambling licence and has in the past appeared on ACMA (Australian Communications and Media Authority) blocklists under the Interactive Gambling Act. If you are physically present in Australia or any other Prohibited Jurisdiction, you must not use the Services where doing so would breach applicable law. It is your responsibility to ensure that your use of the Site is lawful in your jurisdiction.
Registration process
- Account creation: To open an Account you must complete the online registration form on oshi-aussie.com, providing a valid email address, a secure password, and any other information requested. You must confirm that you have read and accepted these Terms and the Privacy Policy.
- Email verification: The Operator may require you to verify your email address by clicking a confirmation link. Failure to complete email verification within the time specified on the Site may result in suspension or deletion of your Account.
- Single account: You may hold only one Account with the Operator. Creation of multiple accounts (including "duplicate accounts", "fraud accounts", or accounts registered under different email addresses or identities) is prohibited and may result in closure of all related accounts and forfeiture of Bonuses and winnings.
KYC and verification
- Identity checks: The Operator may, at any time, require you to provide valid identification documents (e.g., passport, national ID card, driver licence), proof of address (e.g., utility bill), and, where relevant, proof of ownership of payment methods or source of funds. This is to comply with anti-money-laundering obligations, licence conditions, and internal risk controls.
- Verification timing: The Operator may restrict deposits, wagers, or withdrawals until KYC has been successfully completed. In some cases, verification will be mandatory before any withdrawal is processed, regardless of previous deposits or betting activity.
- Failure to verify: If you fail to provide requested documents, provide false or misleading information, or the Operator cannot reasonably verify your identity or eligibility, the Operator may suspend or close your Account, void Bonuses, and, where required by law or regulation, retain or return any remaining balance as appropriate.
User obligations
- Accuracy of data: You warrant that all information you provide during registration and throughout your use of the Services is true, complete, and up-to-date. You must promptly update your Account details if your information changes.
- Password security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your Account. You must:
- Choose a strong, unique password and keep it secret;
- Not allow any third party to access or use your Account;
- Immediately notify customer support at [email protected] if you suspect unauthorised access or security compromise.
- Account use: You must not use the Services for any unlawful purpose, including fraud, money laundering, or payment card misuse. You must not act as an agent or on behalf of other persons. The Operator may report suspicious activity to relevant authorities, including outside Curaçao.
Betting & Gameplay Rules
General rules for placing bets
- Game rules: Each game or category of games (e.g., slots, table games, live casino) is governed by its specific rules, pay-tables, and/or return-to-player (RTP) information, as displayed within the game interface or help section. By placing a Bet you agree to be bound by those rules.
- Minimum and maximum stakes: Minimum and maximum bet amounts are determined on a per-game basis and are displayed in the game interface. The Operator may set overall account-level limits and may change such limits at any time to comply with risk, legal, or responsible gambling requirements.
- Bet confirmation: A Bet is deemed placed and accepted when it is registered on the Operator's servers and appears in your game or transaction history. If any disagreement arises about whether a Bet has been placed or the amount of the Bet, the records of the Operator's systems will be decisive, subject to manifest error.
Cancellation and modification of bets
- No unilateral cancellation: Once a Bet has been confirmed and accepted by the Operator, you cannot cancel or modify it, except where a specific game rule expressly permits cancellation prior to the outcome being determined.
- Operator's right to void: The Operator may, in its sole discretion, refuse, limit, or void any Bet, or a portion thereof, if:
- There is a technical or human error (including incorrect odds, game malfunction, or misconfiguration);
- The Bet was placed after the outcome was known or should reasonably have been known;
- There is evidence of fraud, collusion, exploitation of software bugs, use of bots or automated systems, or any other form of unfair advantage.
- Settlement: Winnings from valid Bets will be credited to your Account immediately or as soon as reasonably practicable once the outcome is confirmed by the Operator's systems and/or the relevant game provider.
Conduct in live casino and chats
- Respectful behaviour: When participating in live casino games, chat rooms, or any interactive features, you must:
- Refrain from using abusive, racist, sexist, defamatory, obscene, or otherwise offensive language;
- Not harass, threaten, or insult other players, dealers, or staff;
- Not promote illegal activities, other gambling sites, or third-party services.
- Prohibitions: You must not:
- Engage in collusion with other players;
- Use scripts, robots, or external assistance devices to gain an unfair advantage;
- Exploit any errors, latency, or disconnections to influence game results.
- Enforcement: The Operator may remove chat messages, mute or restrict your chat access, suspend or close your Account, and/or void Bets and withhold Bonuses if you violate these conduct rules.
Bonus Terms
Bonus activation and eligibility
- Offer-specific conditions: Each Bonus or promotion advertised on oshi-aussie.com or via Oshi is subject to the specific terms stated in the relevant offer (e.g., qualifying deposit amount, eligible games, expiry date). In the event of any conflict, the offer-specific conditions prevail over these general Bonus Terms.
- Activation: Bonuses may require:
- Opt-in via the promotions page or cashier;
- Entry of a promo code; and/or
- Making a qualifying deposit within a set timeframe.
- Account eligibility: Bonuses are personal, non-transferable, and may only be claimed once per person, household, IP address, email address, device, or payment method, unless expressly stated otherwise.
Wagering requirements and timeframes
- Standard wagering: Unless otherwise specified, Bonus Funds and any winnings derived from Bonus Funds are subject to wagering requirements which must be met within the timeframe stated in the offer (for example, 40x the Bonus amount within 7 days). The specific multiplier and timeframe will be clearly disclosed with each promotion and will not extend beyond 2026 for any active offers at the time of these Terms.
- Order of wagers: Unless stated otherwise in the Bonus rules, Real Money Balance is wagered before Bonus Funds. Only bets placed after the Bonus has been activated and while it remains valid count towards the wagering requirements.
- Non-completion: If you do not meet the wagering requirements within the relevant timeframe, the Bonus Funds and any winnings generated from those funds will be forfeited and removed from your Account, while your Real Money Balance (if any) will remain.
Prohibited games, bets, and actions
- Game restrictions: Certain games or game categories may be excluded or contribute at a reduced rate towards wagering requirements (e.g., some table games, live casino games, and low-risk bets). The list of restricted or reduced-contribution games is set out in the Bonus rules on the Site and may be updated from time to time.
- Irregular play: You must not:
- Place single or multiple bets equal to or exceeding the maximum bet size stated in the Bonus rules while wagering a Bonus;
- Use "low risk" betting strategies (for example, placing both sides of the same bet, or offsetting bets) to artificially meet wagering requirements;
- Delay game rounds, such as saving free rounds or bonus features for later when wagering requirements have been met.
- Consequences: In cases of irregular play or abuse, the Operator may remove Bonuses and associated winnings, adjust your balance, and/or close your Account.
Combining promotions
- No stacking by default: Unless expressly stated, Bonuses and other promotional offers cannot be combined or "stacked". Only one active Bonus may be wagered at any time.
- Sequence of use: If you have multiple Bonuses pending, they will be applied in the order determined by the Operator's system. You may be required to complete or cancel an existing Bonus before claiming a new one.
- Cancellation: You may request cancellation of an active Bonus through the Account interface or by contacting support. Upon cancellation, any remaining Bonus Funds and associated winnings will be forfeited, while unaffected Real Money Balance will remain.
Payments & Withdrawals
Deposits
- Methods: The Site may support deposits via:
- Bank cards (e.g., Visa, Mastercard);
- Selected e-wallets and payment services;
- Cryptocurrencies, where available.
- Limits and fees: Minimum and maximum deposit limits per transaction and per day/week/month will be displayed in the cashier section. The Operator does not usually charge deposit fees, but your bank, e-wallet, or crypto service may impose its own fees or currency conversion charges.
- Source of funds: You may only deposit using payment methods registered in your own name. The Operator may request proof of ownership and declines liability for deposits made via third-party methods that are later disputed or reversed.
Withdrawals
- General conditions: Subject to successful KYC and compliance checks, you may request withdrawals of your Real Money Balance and any winnings not subject to outstanding wagering requirements. Withdrawals must, where feasible, be made via the same payment method used for deposit ("closed-loop" policy).
- Processing times: The Operator aims to process withdrawal requests within a reasonable timeframe, generally within 0 - 3 Business Days after approval, excluding any additional time taken by your payment provider. Processing may be delayed where further verification or compliance checks are required.
- Limits and fees: Withdrawal limits (per transaction, per day/week/month) will be published on the Site and may vary by status, payment method, or jurisdiction. The Operator may charge reasonable withdrawal fees for multiple small withdrawals or specific methods, which will be disclosed before you confirm the transaction.
Chargebacks, reversals, and refunds
- Chargebacks and reversals: If a deposit is charged back, reversed, or otherwise cancelled by you or your payment provider, the Operator may:
- Deduct the outstanding amount from your Account balance;
- Void any Bets and winnings arising from the reversed deposit;
- Close or suspend your Account and report the matter to relevant authorities or payment providers.
- Refunds: Bets already settled in accordance with game rules are final and cannot be cancelled or refunded, except where a game malfunction or error has occurred. In such cases, the Operator may, in its discretion, restore the balance to the pre-event state or otherwise resolve the issue in accordance with the applicable game provider's policies.
- Bonuses and refunds: Where refunds are granted in exceptional circumstances, any related Bonuses and associated winnings may be removed to prevent unjust enrichment or Bonus abuse.
Limitation of Liability
Operator's obligations
- Fairness and integrity: The Operator undertakes to provide the Services with reasonable skill and care, including:
- Using licensed software and reputable game providers whose random number generators (RNGs) are subject to testing by independent laboratories (e.g., iTech Labs via game providers such as Bgaming, as referenced in institutional sources, noting that certification is at provider level unless otherwise stated);
- Ensuring that game outcomes are determined by the relevant RNG and game rules, without manipulation by the Operator.
- Accuracy of results: The Operator will take reasonable steps to ensure that game results and Account balances are accurately recorded and displayed. In the event of discrepancy between your on-screen display and the Operator's server records, the latter will generally prevail, subject to manifest error.
Exclusions of liability
- Technical failures and interruptions: To the maximum extent permitted by applicable law, the Operator is not liable for:
- Any interruptions, delays, or failures of the Site or Services caused by network congestion, hardware or software failure, power outages, denial-of-service attacks, or other technical reasons beyond its reasonable control;
- Losses arising from your own equipment, internet connection, or software, including inability to place or settle Bets.
- Indirect and consequential loss: The Operator will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or reputational harm, even if it has been advised of the possibility of such damages.
- Legal compliance in your jurisdiction: The Services are offered under Curaçao law. The Operator does not guarantee that access to or use of the Services is lawful in your jurisdiction (including Australia). You are solely responsible for ensuring that your use of the Site complies with all local laws. The Operator disclaims liability where you breach local law, including the Australian Interactive Gambling Act.
Maximum liability
- Cap on compensation: Without limiting the above, and to the extent permitted by applicable law, the maximum aggregate liability of the Operator to you arising out of or in connection with any single incident or series of related incidents shall not exceed:
- The amount of the Bet or Wager directly related to the incident; or
- Where no Bet is directly applicable, the amount of your net deposits to your Account over the 90 days preceding the incident, up to a reasonable cap determined by the Operator, whichever is lower.
- Non-excludable rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory law applicable to the Operator, including any non-excludable consumer guarantees to the extent they apply.
Intellectual Property Rights
Ownership
- Content and software: All intellectual property rights in and to the Site and the Services, including but not limited to trademarks, logos, domain names (including oshi-aussie.com and associated review pages), text, graphics, user interfaces, photographs, animations, audio, video, game software, and underlying source code, are owned by the Operator, its group companies, licensors, or content providers.
- Limited licence: Subject to your compliance with these Terms, the Operator grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Site and Services for your private, non-commercial entertainment purposes only.
Restrictions
- Prohibited uses: You must not, without the prior written consent of the Operator:
- Copy, reproduce, republish, modify, adapt, translate, or create derivative works from any part of the Site or Services;
- Sell, lease, rent, sublicense, or otherwise distribute any content or software from the Site;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used in connection with the Services, except to the extent expressly permitted by mandatory law.
- Trade marks: All trade names, trademarks, service marks, and logos used on the Site are the property of their respective owners and may not be used by you without prior written consent.
Privacy & Data Protection
- Privacy Policy: The Operator processes personal data in accordance with its Privacy Policy as published on oshi-aussie.com. The Privacy Policy explains how your information is collected, used, stored, shared, and protected, and sets out your rights in relation to your personal data.
- Data processing: By using the Site or creating an Account, you acknowledge and agree that your personal data may be processed by Dama N.V., Strukin Ltd, and selected third-party service providers (including payment processors and game providers), which may involve cross-border transfers in accordance with applicable data protection laws.
- Consent and updates: Where required by law, your consent to specific data processing activities will be obtained separately. You should review the Privacy Policy regularly, as continued use of the Services after updates indicates your acknowledgement of the revised policy.
Changes to Terms
- Right to amend: The Operator may amend, update, or replace these Terms from time to time to reflect changes in law, regulatory requirements, industry practice, or business operations. Updated Terms will indicate the new effective date (not later than 31 December 2026 for changes anticipated at the time of these Terms).
- Notification: Where changes are material, the Operator will take reasonable steps to notify you, which may include:
- Displaying a prominent banner or pop-up notice on the Site;
- Sending an email to the address registered in your Account.
- Your acceptance: Continued use of the Services after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with any updated Terms, you must stop using the Site and may request closure of your Account and withdrawal of any eligible balance, subject to standard verification and withdrawal procedures.
Termination & Suspension
Termination by you
- Account closure: You may close your Account at any time by:
- Using the account closure function (where available) in your profile; or
- Contacting customer support at [email protected] with a clear request to close your Account.
- Remaining funds: Upon valid closure and subject to verification, any remaining Real Money Balance will be paid to you via an agreed withdrawal method, provided no fraud, chargeback, or breach of these Terms is suspected.
Suspension and termination by the Operator
- Grounds: The Operator may suspend or terminate your Account, restrict your access to the Services, or void Bets and Bonuses if:
- You breach or are reasonably suspected of breaching these Terms or any game or Bonus rules;
- The Operator suspects fraud, collusion, money laundering, or other unlawful or improper activity;
- You fail to pass or cooperate with KYC or other verification checks;
- The Operator is required to do so by law, a regulatory authority, or its licensing conditions (including where access from certain jurisdictions, such as Australia, is restricted or blocked);
- Your Account remains inactive for an extended period, in which case the Operator may also charge a reasonable inactivity fee, where permitted by law and disclosed on the Site.
- Consequences: On suspension or termination:
- Any unsettled Bets may be voided in accordance with game rules and applicable law;
- Bonuses and associated winnings may be removed, particularly where misuse or breach has occurred;
- Subject to legal and regulatory obligations, any remaining Real Money Balance may be returned to you or held pending investigation.
- Notice: Where legally and practically possible, the Operator will notify you by email of the suspension or termination and the main reasons for such action. However, the Operator is not obliged to provide details that could compromise fraud investigations or legal obligations.
Governing Law & Jurisdiction
- Governing law: These Terms, your use of the Site, and any contract between you and the Operator are governed by and construed in accordance with the laws of Curaçao, excluding its conflict of law rules, unless mandatory consumer protection laws of your place of residence require otherwise.
- Dispute resolution: If you have a complaint, you should first contact customer support at [email protected]. The Operator will attempt to resolve your complaint internally in a fair and timely manner.
- Escalation: If a dispute cannot be resolved internally, it may, where applicable under Curaçao law and licensing conditions, be referred to an independent dispute resolution body or the relevant Curaçao e-gaming authority, in accordance with the procedures set out on the Site or by the authority.
- Courts and arbitration: Subject to any mandatory arbitration or dispute resolution requirement under the Operator's licence, you agree that any legal proceedings arising out of or relating to these Terms shall be brought in the competent courts of Curaçao, and you irrevocably submit to the jurisdiction of those courts. Nothing in this clause limits any non-waivable rights you may have to bring a claim in the courts of your place of residence under mandatory consumer laws that apply to you.
